• Fence Repair

From The Godfather@21:3/165 to All on Friday, August 19, 2022 09:59:58
So we had two major storms come through that sent a neighbors tree into our yard and completely destroy my kids play set. There was no saving it, and no money to replace it. The kids are pretty bummed out but apparently the neighbors insurance does not provide liability coverage for "acts of god" for us, but does so for getting the remainder of his tree cut down and any damage to his property fixed. Of course, if I want to pay a high deductible, have my insurance rates go up, my kiddos could have a playset. Well .. money is tight, I would imagine, for many, I of which am not immune to. So I'm fixing what I can, and I have 3 fence posts that are holding on for dear life (half to fully cracked at the base where the cement begins...) Since I have a dog, I'd like to find an affordable way to fix these 3 posts the most affordable way I can. Any suggestions other then buying pressure treated 4x4's and a bag of concrete for each, that has worked for you in the past? I'm going to assume no, but hey, thought I'd ask :)

How much is a playset? Happy to chip in if it's something that can be replaced.

This is good advice - I'd also recommend Nextdoor. Lots of free stuff being given away on that app.

You have had smoke blown up your backside by your neighbor.

Whatever their tree smushed, the neighbor is responsible for.

If they have el-cheapo insurance, their liability doesn't go away.

Same if they were "running naked" (being uninsured) they remain responsible.

You will have to judge if the neighbors truly don't understand or if they are adding salt to the wound (that their tree caused), in how you want to approach this.

Fortunately their tree didn't do real damage, like smash part of your house, or car, or kill someone.

But they are responsible insured, under-insured or uninsured, plain and simple.

    Good luck!

Ding ding ding. I'd hate having to go thru it - but this is exactly what I'd do. I'd put it in writing in an envelope and goto the neighbor. I'd state to them that "Your tree damaged my property when it fell down. These are my damages; x, y, z. You are responsible for the repair." I'd get a professional estimate for the fence repair and I'd find a brand new play-set and use its Amazon ad and price as its 'estimate'. I'd forward both of those, afterward, to the neighbor. Once I gave all the estimates I'd ask the neighbor how they are going to handle it - cash or check?

You don't have to use your insurance - nothing on your property caused any damage. The neighbor is simply responsible to repair any damage their property caused. If they refuse, I'd go to your local court and file a small claims lawsuit. You could do all of this within a week. A good neighbor will simply pay; it sucks, but its what they have to do. If they don't, a judge will side with you.

:/ Sorry yer dealing with this. Furthermore, I know money is tight but you can even just have the fence repaired - you'll get the money back.

Some potential fixes, but a lot depends on what condition the posts are in, what tools & skills you have.

Sleeve, socket, glue, plate are the four ideas that come to mind.

If the in the ground piece has enough exposure, you could have a metal sleeve made to rejoin/reinforce the posts.

If there isn't enough and you have access to an agur drill and hammer drive, you can hollow out both parts and expoy in rods or dowels to bridge.

If it is more alike a green-tree bone fracture, you could fill it up with expoxy glue and straighten.

Plating is like sleeving but would be two flat pieces of metal on either side of the break, with through bolts.

Unless you have tools and supplies, any of these may be more expensive than replacement. The bags of sacrete and new posts are not cheap, but they may be the lowest cost and longest durability solution.

I messed around with a mailbox post when a neighbor pushed mine over, and in the end a new post and a bag of sacrete was the only durable solution.

Pretty sure I mentioned I spoke to the Neighbor AND their insurance company; including my own. That IS how it works. But thank you everyone for the advice.

Couple of things; If you know or can find someone around your area with a sawmill they may be able to set you up with some 4x4s a bit cheaper than going to a big store. I know a guy here that takes old telephone poles and cuts them into treated lumber and it seems to work great.

There's another idea, if you can catch the power company replacing some posts maybe you could talk them out of one of the old poles that you could cut into three long enough to replace those 4x4s?

Another idea; go to a farmers supply store (Tractor supply if you have them) and get some of those metal fence posts that you drive into the grond. Might could put them in close enough to secure the poles a bit til you can do something better?

    Good luck with the replairs!
